A House of Assembly aspirant for Njikoka state constituency II, in Anambra State, Mr. Emeka Onwubuya, has dragged the Independent National Electoral Commission, INEC, and the person declared winner of the primary, Mr. Peter Ibida, to the Federal High Court sitting in Awka, urging the court to stop All Progressives Grand Alliance (APGA) from recognizing Ibida as the candidate of the party for the constituency.

In his suit, Onwubuya claimed that he defeated Ibida during the party primaries conducted in the area and wondered why the party jettisoned the result of the primaries and forwarded the name of the loser to INEC.
The suit, which is before Justice Bature Gafai, is expected to determine: whether by the combined provisions of section 87(1)(2)(3)(4)(5) and (7)of the Electoral Act 2010 as amended and Article (46)(9) of APGA electoral guidelines for conduct of primary election for the 2019 general election, APGA could declare the second defendant (Peter Ibida),his fellow candidate for Njikoka state constituency II, when Ibida did not poll the highest number of votes cast at the primary election held on October 4, 2018?.
He also prayed the court to rule that he (Onwubuya) is the authentic and duly nominated candidate of APGA for Njikoka state constituency II, having complied with all the requirements of the party and having polled the highest number of votes cast by the statutory delegates at the primary election of APGA held on October 4,2018.
Among his prayers were: *An order restraining APGA either itself, officers, privies, staff or through any person from submitting the name of Ibida as its candidate for Njikoka state constituency II for the 2019 general election;
*An injunction restraining APGA from recognizing, accepting and dealing with Ibida as the authentic candidate or allowing Ibida to participate in the House of Assembly election slated for March 2,in 2019.
